Being a member of a minority group makes it harder to succeed in academic philosophy. Research suggests that students from underrepresented groups have a hard time in academic philosophy and often drop out instead of pursuing a career in philosophy, despite having the potential to become excellent philosophers. In this paper, I will argue that there is a specific way of thinking about traditional conceptual analysis within analytic philosophy that marginalizes underrepresented groups. This has to do with what kinds of (...) analyses we philosophers think are worthy of conducting and with who we think are worthy of pursuing such analyses. I will then show why this is particularly worrisome for the profession of philosophy as an institution geared towards the love of knowledge and argue that it should be in our interest as philosophers to find ways to prevent this marginalization of underrepresented groups. Finally, I will provide an example of how to do philosophy differently that does not exclude members of underrepresented groups and suggest ways in which the teaching of analytic philosophy can directly counter the discriminatory practices of academic philosophy. Hänel proposes a theory of rape as a social practice facilitated by ubiquitous sexist ideologies. Arguing for a normative cluster model for the concept of rape, this timely intervention improves our understanding of lived experiences of sexual violence and social relations within (...) sexist ideologies. Miranda Fricker’s account of hermeneutical injustice and remedies for this injustice are widely debated. This article adds to the existing debate by arguing that theories of recog- nition can fruitfully contribute to Fricker’s account of hermeneutical injustice and can provide a framework for structural remedy. By pairing Fricker’s theory of hermeneutical injustice with theories of recognition, I bring forward a modest claim and a more radical claim. The first concerns a shift in our vocabulary; recognition theory can give a name (...) to the seriousness of the long-term effects of hermeneutical injustice. The second claim is more radical: thinking of hermeneutical injustice as preventing what I call “self-recogni- tion” provides a structural remedy to the phenomenon of hermeneutical injustice. Because hermeneutical injustice is first and foremost a structural injustice, I contend that every virtue theory of hermeneutical justice should be complemented by structural remedies in terms of recognition. Finally, what I argue sheds light on the seriousness of cases of exclusion of and discrimination against women in academia and helps to draw our attention to new ways to combat such problems. One night in 2017, ‘Grace’ went on a date with actor Aziz Ansari. She later described the date as “the worst experience with a man I’ve ever had,” and accused him of sexual assault. In a statement, he responded by saying that the sexual activity was completely consensual. While Grace felt pressured, uncomfortable, and violated, he was convinced that the sexual acts were consensual. How is it possible that a man who describes himself as an ally to the feminist cause (...) engages in such unacceptable actions and seems incapable of understanding them for what they are, that is, acts of sexual violence? And how is it possible that a woman who feels uncomfortable is still incapable of resisting further advances? In this paper, I argue that such cases have to be understood within the framework of a ‘sexist ideology,’ that is, a social structure that constrains our actions and epistemic tools of interpretation. What hinders Ansari from understanding the act as sexual violence and what hinders Grace from resisting Ansari is the complex set of interconnected sexist practices which determine who owes what to whom based on different gendered roles. In this paper, I use the example of rape myths to argue that certain real-life phenomena compel us to adjust our philosophical methods such that we explicitly endorse feminist commitments and strive for democratic practices in our philosophical thinking. The concept of rape has evolved significantly over the past few decades both in law and common usage. But despite decades of work to dispel rape myths, they persist and interfere with the proper application of the concept. This paper aims to (...) account for this problem and propose a solution. First, I consider three examples that show how rape myths and other problematic schemas can distort our dominant working understanding of phenomena. All three examples are cases of grave injustices to the victims. I suggest that a revisionary project of conceptual amelioration can help counter injustices like these. In a second step, I argue that problematic schemas (such as rape myths) not only distort our working understanding or the accurate application of an existing concept, but can furthermore interfere with our philosophical analyses—even in cases of amelioration. As a solution, taking clues from theories of epistemologies of ignorance, I propose a more democratic and progressive method for engaging in conceptual amelioration. (shrink)

We can currently see the formation of new nationalist and racist parties or tendencies within established parties to lean towards right-wing politics within many European countries; from the Alternative für Deutschland in Germany, the Partij voor de Vrijheid (PVV) in the Netherlands, Lega Nord or Lega in Italia, Vox in Spain, the Freiheitliche Partei Österreichs, Front National in France, the Sverigedemokraterna in Sweden, Fidesz in Hungary, and Golden Dawn in Greece, to name only a few. At the same time, there (...) has been a surge in racist, fascist, and antisemitic attacks within Europe. Since 1991, Neo-Nazi gangs have attacked migrants and members of antifascist groups, burned down housing facilities for asylum seekers (including facilities for Ukrainian refugees in 2022), disrupted social initiatives, and spread fear (BfV, 2022; cf. Speit, 2021). However, most of these activities were described as the criminal action of socially marginalized individuals, downplaying the organized structure behind these far-right activities and, thus, paving the way for more attacks. Part of this paper is to show how the epistemic tools developed by the epistemology of ignorance literature can help to understand (a) why the organized structures of far-right movements are unintelligible within the dominant frame of intelligibility in Europe and (b) how the silence about far-right movements shifts the boundaries for what can be said or done, thus, having deeply problematic repercussions for who can feel safe in Europe. This paper has a modest aim: By bringing into focus contexts of social injustice that have not received much attention in the current literature and by understanding them with the help of existing research from the debate on problematic epistemic practices and philosophy of language, the paper aims to highlight some problematic practices. In this paper, we have two goals. First, we argue for a blueprint for hermeneutical injustice that allows us to schematize existing and discover new varieties of hermeneutical injustices. The underlying insight is that Fricker provides both a general concept of hermeneutical injustice and a specific conception thereof. By distinguishing between the general concept and its specific conceptions, we gain a fruitful tool to detect such injustices in our everyday lives. Second, we use this blueprint to provide a further example (...) of hermeneutical injustice that draws our attention to yet another distinction: Some hermeneutical injustices result from a lack or distortion in the collective conceptual resource and some are due to problems in the application of existing concepts. We argue that to combat hermeneutical injustices, we have to make sure not only that individuals have accurate concepts at their disposal but that they have the capabilities to use these concepts adequately. This article focuses on three themes concerning determinism and indeterminism. The first theme is observational equivalence between deterministic and indeterministic models. Here I discuss several results about observational equivalence and present an argument on how to choose between deterministic and indeterministic models involving indirect evidence. The second theme is whether Newtonian physics is indeterministic. I argue that the answer depends on what one takes Newtonian mechanics to be, and I highlight how contemporary debates on this issue differ from those in (...) the nineteenth century. The third major theme is how the method of arbitrary functions can be used to make sense of deterministic probabilities. I discuss various ways of interpreting the initial probability distributions and argue that they are best understood as physical, biological etc. quantities characterising the particular situation at hand. Also, I emphasise that the method of arbitrary functions deserves more attention than it has received so far. (shrink)

The general theme of this article is the actual practice of how definitions are justified and formulated in mathematics. The theoretical insights of this article are based on a case study of topological definitions of chaos. After introducing this case study, I identify the three kinds of justification which are important for topological definitions of chaos: natural-world-justification, condition-justification and redundancy-justification. To my knowledge, the latter two have not been identified before. I argue that these three kinds of justification are widespread (...) in mathematics. After that, I first discuss the state of the art in the literature about the justification of definitions in the light of actual mathematical practice. I then go on to criticize Lakatos’s account of proof-generated definitions—the main account in the literature on this issue—as being limited and also misguided: as for topological definitions of chaos, in nearly all mathematical fields various kinds of justification are found and are also reasonable. The received wisdom in statistical mechanics is that isolated systems, when left to themselves, approach equilibrium. But under what circumstances does an equilibrium state exist and an approach to equilibrium take place? In this paper we address these questions from the vantage point of the long-run fraction of time definition of Boltzmannian equilibrium that we developed in two recent papers. After a short summary of Boltzmannian statistical mechanics and our definition of equilibrium, we state an existence theorem which provides general (...) criteria for the existence of an equilibrium state. We first illustrate how the theorem works with a toy example, which allows us to illustrate the various elements of the theorem in a simple setting. After a look at the ergodic programme, we discuss equilibria in a number of different gas systems: the ideal gas, the dilute gas, the Kac gas, the stadium gas, the mushroom gas and the multi-mushroom gas. The main aim of this paper is to investigate how sexist ideology distorts our conceptions of sexual violence and the hermeneutical gaps such an ideology yields. I propose that we can understand the problematic issue of hermeneutical gaps about sexual violence with the help of Fricker’s theory of hermeneutical injustice. By distinguishing between hermeneutical injustice and hermeneutical misfire, we can distinguish between the hermeneutical gap and its consequences for the victim of sexual violence and those of the perpetrator of such (...) violence. I then argue that perpetrators are both morally responsible and accountable for their acts, even if they are the result of a hermeneutical misfire. Ultimately, I show that with regard to sexual violence, we should opt for accountability to change the behaviour of the perpetrator and the social structure. Although it is clear in Schelling's Freiheitsschrift that he takes an agent's atemporal choice between good and evil to be central to understanding human freedom, there is no consensus in the literature and no adequate account of how to understand this choice. Further, the literature fails to render intelligible how existential freedom is possible in the light of this atemporal choice. I demonstrate that, despite their differences, the dominant accounts in the literature are all guilty of these failings and argue (...) that this is due to their misunderstanding of Schelling's conception of the relationship between essence and form. After outlining what I take Schelling's account of this relationship to be, I return to the Freiheitsschrift to demonstrate that with this account in mind we can make intelligible Schelling's claims about the agent's atemporal act, and the possibility of existential freedom on his account. ABSTRACT When does a state of affairs constitute a harm to someone? Comparative accounts say that being worse off constitutes harm. The temporal version of the comparative account is seldom taken seriously, due to apparently fatal counterexamples. I defend the temporal version against these counterexamples, and show that it is in fact more plausible than the prominent counterfactual version of the account. Non-comparative accounts say that being badly off constitutes harm. However, neither the temporal comparative account nor the non-comparative account (...) can correctly classify all harms. I argue that we should combine them into a hybrid account of harm. The hybrid account is extensionally adequate and presents a unified view on the nature of harm. (shrink)

In the debate on epistemic injustice, it is generally assumed that testimonial injustice as one form of epistemic injustice cannot be committed (fully) deliberately or intentionally because it involves unconscious identity prejudices. Drawing on the case of sexual violence against refugees in European refugee camps, this paper argues that there is a form of testimonial injustice—willful testimonial injustice—that is deliberate. To do so, the paper argues (a) that the hearer intentionally utilizes negative identity prejudices for a particular purpose and (b) (...) that the hearer is aware of the fact that the intentionally used prejudices are in fact prejudices. Furthermore, the paper shows how testimonial injustice relates to recognition failures both in terms of a causal as well as a constitutive claim. In fact, introducing willful testimonial injustice can support the constitutive claim of such a relation that has so far received little attention. Besides arguing for a novel form of testimonial injustice and contributing to the recent debate on the relation between epistemic injustice and recognition failures, this paper is also motivated by the attempt to draw attention to the inhumane conditions for refugees at the border of Europe as well as elsewhere. Eric Cassell famously defined suffering as a person’s severe distress at a threat to their personal integrity. This article draws attention to some problems with the concept of distress in this theory. In particular, I argue that Cassell’s theory turns on distress but does not define it, which, in light of the complexity of distress, problematizes suffering in three ways: first, suffering becomes too equivocal to apply in at least some cases that Cassell nevertheless identifies as suffering; second, Cassell’s account (...) does not explain what sort of experience suffering is, resulting in theoretical and practical difficulties in distinguishing it from other medical conditions; third, there is good reason to believe that, in medical contexts, ‘distress’ just means ‘suffering’ or some cognate concept not yet distinguished from it, rendering Cassell’s theory circular. I consider a rebuttal to my objections and reply, concluding that Cassell’s theory of suffering needs a definition of distress to settle what the nature of suffering really is. (shrink)

Garrett Cullity contends that fairness is appropriate impartiality (See Cullity (2004) Chapters 8 and 10 and Cullity (2008)). Cullity deploys his account of fairness as a means of limiting the extreme moral demand to make sacrifices in order to aid others that was posed by Peter Singer in his seminal article ‘Famine, Affluence and Morality’. My paper is founded upon the combination of (1) the observation that the idea that fairness consists in appropriate impartiality is very vague and (2) the (...) fact that psychological studies show the self-serving bias is especially likely to infect one’s judgements when the ideas involved are vague. I argue that Cullity’s solution to extreme moral demandingness is threatened by these findings. I then comment on whether some other theories of fairness are vulnerable to the same objection. In a criminal trial, a judge or jury needs to reason about what happened based on the available evidence, often including statistical evidence. While a probabilistic approach is suitable for analysing the statistical evidence, a judge or jury may be more inclined to use a narrative or argumentative approach when considering the case as a whole. In this paper we propose a combination of two approaches, combining Bayesian networks with scenarios. Whereas a Bayesian network is a popular tool for analysing (...) parts of a case, constructing and understanding a network for an entire case is not straightforward. We propose an explanation method for understanding a Bayesian network in terms of scenarios. This method builds on a previously proposed construction method, which we slightly adapt with the use of scenario schemes for the purpose of explaining. The resulting structure is explained in terms of scenarios, scenario quality and evidential support. A probabilistic interpretation of scenario quality is provided using the concept of scenario schemes. Finally, the method is evaluated by means of a case study. (shrink)

The Metaphysics of Gender is a book about gender essentialism: what it is and why it might be true.

InThe Second Sex, Simone de Beauvoir argues that women are often complicit in reinforcing their own unfreedom. But why women become complicit remains an open question. The aim of this article is to offer a systematic analysis of complicity by focusing on the Heideggerian strands of Beauvoir's account. I begin by evaluating Susan James's interpretation of complicity qua republican freedom, which emphasizes the dependent situation of women as the primary cause of their complicity. I argue that James's analysis is compelling (...) as far as it goes, but that it implies complicity is the inevitable outcome of women's current existence and fails to adequately account for Beauvoir's claim that women actively embrace their own unfreedom. I then draw out the Heideggerian strands of Beauvoir's analysis, demonstrating how this enables us to systematize Beauvoir's account of women's oppressive situation with her claims regarding the active role women can play in reinforcing their own unfreedom. I argue that this approach preserves the strengths of the republican interpretation, but provides a better account of cases where complicity may not be inevitable and yet some women still act to reinforce rather than resist their own unfreedom. While Hegel's metaphysics was long reviled, it has garnered more interest in recent years, with even the so-called non-metaphysical Hegelians starting to explicitly discuss Hegel’s metaphysical commitments. This brings up the old question: what are the social-philosophical implications of Hegel’s metaphysics? This chapter provides a unique answer to this question by contrasting the former non-metaphysical reading (as developed by Robert Pippin) with a traditional way of interpreting Hegel’s metaphysics and social philosophy, whose lineage includes not Wittgenstein, Sellars, or Brandom, but (...) rather Schelling, Marx, and Adorno. After discussing the two varieties of metaphysics (Sections 1–3), I will argue that a traditional metaphysical Hegel is more realist when it comes to assessing the power of social structures (Section 4), focused on structural freedom rather than agency (Sections 5 and 6), and more empowering for and lenient towards individuals who can make their interests count and are free to be irrational and egoist (Section 7). Many people believe that we have moral duties towards those we bring into existence in the short term: our children. Many people also believe that we have moral duties towards those we bring into existence in the long term: future generations. In this article, I explore how these beliefs are connected. I argue that the present generation is morally responsible for future generations in virtue of bringing them into existence. This responsibility entails moral duties to ensure that future people have (...) adequate life prospects. These duties are held directly towards future generations. I argue that this direct argument can overcome challenges that indirect arguments, which justify moral duties concerning future generations via moral duties towards present children, face. The upshot is that considerations from procreative ethics help to illustrate that the present generation stands in a morally relevant special relationship to future generations, a fact that is often overlooked in intergenerational ethics. In a criminal trial, evidence is used to draw conclusions about what happened concerning a supposed crime. Traditionally, the three main approaches to modeling reasoning with evidence are argumentative, narrative and probabilistic approaches. Integrating these three approaches could arguably enhance the communication between an expert and a judge or jury. In previous work, techniques were proposed to represent narratives in a Bayesian network and to use narratives as a basis for systematizing the construction of a Bayesian network for a legal (...) case. In this paper, these techniques are combined to form a design method for constructing a Bayesian network based on narratives. This design method is evaluated by means of an extensive case study concerning the notorious Dutch case of the Anjum murders. (shrink)

This paper argues that close personal relationships play an important role in our judgments about what is fair. I start with an explanation of leading theories of fairness, highlighting the potential for further work on the grounds of fairness. Next, I offer an account of close personal relationships as having the ability to generate legitimate and reasonable expectations of one or other party to a judgment about fairness, or both. I show how and when close personal relationships can ground fairness.

This article examines stasis in Chantal Akerman's cinema by means of a genealogical study into its minimalist origins in order to make visible its political operationality in her work and, by extension, its inherent political potential. Stasis is an aesthetic effect generated through the use of repetition, seriality, and duration in temporal media that proliferated in Minimalism across artforms and was taken up by Akerman during her séjour in New York in the early 1970s. The characteristic endless temporality created by (...) stasis in temporal media takes shape in Minimalism due in part to the movement's literalist, phenomenological orientation, which at one point caused Minimalist art to be regarded as nonideological – this while the static quality in Akerman's work appears to be constitutive of its political character. A study of her early films Hotel Monterey (1972) and Je tu il elle (1974), clearly influenced by the Minimalist scene she was immersed in, illustrates how stasis emerges analogously in Minimalist music, dance, and Akerman's cinema. Minimalism's paradigmatically phenomenological orientation and its intricate entwinement with stasis are examined in relation to Akerman's work to reveal their inherent potential for political operationality in art.
